By offering daily futures, Bakkt has managed to get under CFTC regulation while offering a product mimicking the unregulated spot market. By letting the contracts be margined, the contracts on Bakkt will not be fully backed before settlement. The combination of regulation and leverage is likely to attract new institutional money.
